Welcome to our mobile applications. These Terms of Use ("Terms") govern your access to and use of the mobile applications ("Apps") provided by DIACONU MOBILE APPS SOCIETATE CU RASPUNDERE LIMITATA ("Company", "we", "us", or "our").

These Terms apply to all mobile applications published and operated by DIACONU MOBILE APPS SOCIETATE CU RASPUNDERE LIMITATA, including applications distributed through the Apple App Store and Google Play. On Google Play, these applications are published under the developer name PostMuse.

By downloading, installing, or using our Apps, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Apps, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Apps.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Apps after any such changes constitutes your acceptance of the new Terms.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Apps for your personal, non-commercial purposes on any device that you own or control.

You may not:

• Copy, modify, or distribute the Apps or any content within them
• Reverse engineer, decompile, or disassemble the Apps
• Remove any copyright, trademark, or other proprietary notices
• Transfer the Apps to another person or "mirror" the Apps on any other server
• Use the Apps for any illegal or unauthorized purpose
• Use the Apps in any manner that could damage, disable, or impair the Apps

4. User Content

Our Apps may allow you to capture, create, or share content such as photos, videos, or other media ("User Content"). You retain all rights to your User Content. By using our Apps, you grant us a limited license to process your User Content solely for the purpose of providing the App's functionality.

You are solely responsible for your User Content and represent that:

• You own or have the necessary rights to use and share your User Content
• Your User Content does not violate the privacy, publicity, copyright, or other rights of any person
• Your User Content does not contain illegal, harmful, or offensive material

5. In-App Purchases and Subscriptions

Our Apps may offer in-app purchases or subscription services. By making a purchase, you agree to pay all applicable fees.

• Subscriptions: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Management: You can manage or cancel your subscriptions through your Apple App Store or Google Play Store account settings.
• Refunds: Refund requests are handled by Apple or Google according to their respective policies. We do not directly process refunds for purchases made through the app stores.
• Price Changes: We reserve the right to change subscription prices. Any price changes will apply to subsequent billing periods.

6. Third-Party Services

Our Apps may integrate with third-party services for analytics, crash reporting, and other functionality. These third-party services have their own terms and privacy policies. We are not responsible for the practices of these third-party services.

7. Intellectual Property

The Apps, including all content, features, and functionality, are owned by DIACONU MOBILE APPS SOCIETATE CU RASPUNDERE LIMITATA and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

8. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Apps will be uninterrupted, secure, or error-free
• The results obtained from the Apps will be accurate or reliable
• Any errors in the Apps will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIACONU MOBILE APPS SOCIETATE CU RASPUNDERE LIMITATA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPS.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APPS SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR ACCESS TO THE APPS DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless DIACONU MOBILE APPS SOCIETATE CU RASPUNDERE LIMITATA and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Apps or your violation of these Terms.

11. Termination

We may terminate or suspend your access to the Apps at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Apps will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Iasi, Romania.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DIACONU MOBILE APPS SOCIETATE CU RASPUNDERE LIMITATA regarding your use of the Apps.
